When a Building Under Renovation Is Damaged by Rocket Fire: A Practical Guide for Residents

Israel’s current security reality, intensified by the ongoing “Operation Roaring Lion,” has forced many families to confront complex and unexpected challenges. Beyond the immediate personal and national concerns, practical questions quickly arise — especially when it comes to property damage and residential buildings.

When a shared apartment building is hit by a missile, the situation is both traumatic and legally complex. Yet according to real estate and urban renewal experts, homeowners should know that Israeli law provides a structured framework for compensation and recovery, with the state bearing primary responsibility for war-related property damage.

Who Pays for the Damage?

If a residential building is damaged as a direct result of hostilities, financial responsibility does not fall on the residents. Compensation for war-related property damage is handled by the state through the Property Tax Compensation Fund, managed by the Israel Tax Authority.

In practical terms, homeowners are not expected to finance reconstruction or major repairs out of pocket. The state’s appointed assessors evaluate the damage and determine the scope of compensation.

What About Temporary Housing?

If residents are evacuated due to direct structural damage or if the area is officially declared an emergency zone, alternative housing arrangements are typically coordinated through public authorities, often in cooperation with local municipalities and emergency services. In most cases, the state covers temporary accommodation costs until the building is deemed safe or a longer-term solution is implemented.

Repair or Demolish?

One of the most critical decisions following significant structural damage is whether the building can be repaired or must be demolished. This determination is made by certified appraisers and engineers working on behalf of the Government Authority for Urban Renewal.

If the structure is considered repairable, authorities generally prefer restoration over demolition. However, if the damage is severe enough to classify the building as a total loss, demolition and reconstruction may be required.

What If the Building Is Already in an Urban Renewal Process?

When a damaged building is already undergoing an urban renewal project — such as evacuation and reconstruction — the situation can become strategically significant.

In some cases, structural damage may accelerate the project’s implementation. Rather than investing public funds in temporary rehabilitation of a structure already designated for demolition, authorities may consider directing compensation resources toward advancing the renewal project itself.

Even in this scenario, the Property Tax Compensation Fund remains obligated to compensate residents for private property damage. With proper legal coordination, these funds can be leveraged to support the redevelopment process and help secure suitable temporary housing until the new building is completed.

Legal representation is particularly important in such cases to safeguard residents’ rights vis-à-vis developers, local authorities and state agencies, especially regarding financing arrangements and interim housing guarantees.

Step-by-Step: What Residents Should Do

The response process typically unfolds in structured stages, depending on whether the urban renewal project has received a building permit.

Before a Building Permit Has Been Issued:

First, document everything. Residents should thoroughly photograph and film all visible damage to both the building and personal property. Debris removal or repair work should be avoided unless there is an immediate safety hazard, and only after documentation is complete.

Second, notify the authorities. Damage must be reported to the Israel Tax Authority within 14 days, and a detailed compensation claim should be submitted within three months.

Third, await professional assessment. An official appraiser and engineer will inspect the site to determine whether the building is repairable or must be demolished.

If renovation is approved, the state finances restoration to return the building to its prior condition. If demolition is ordered — or if the building was already in advanced stages of a redevelopment plan — residents may work with authorities to channel compensation funds toward expediting the renewal project instead of temporary fixes.

After a Building Permit Has Been Granted:

If the project already holds a valid building permit, the process is often more straightforward but requires close coordination.

Structural damage can justify accelerating evacuation and demolition timelines, potentially shortening previously scheduled waiting periods. Regulatory approvals, including traffic and infrastructure arrangements typically required before demolition and reconstruction, may also be fast-tracked under emergency conditions.

The developer’s role becomes more central at this stage. In coordination with the residents’ legal representatives, the developer works to organize evacuation logistics and ensure alternative housing solutions as stipulated in project agreements.

Importantly, even when a developer is contractually committed to rebuilding, residents remain entitled to full compensation from the Property Tax Compensation Fund for damage to personal belongings and other eligible losses.

A Difficult Situation — But a Defined Framework

While missile damage to a residential building is an emotionally and logistically overwhelming event, the legal and administrative system provides a defined path forward. The key for residents is swift documentation, timely reporting and careful coordination with professionals — including engineers, legal advisors and project developers — to ensure both immediate stability and long-term housing security.

In times of uncertainty, understanding the available rights and procedures can make a critical difference in how quickly families return to safe and perm
